Bates Numbering Guide: How to Number Legal Exhibits & Discovery Documents

In civil litigation, criminal proceedings, and government inquiries, thousands of pages of emails, contracts, and records are exchanged during discovery. To maintain an unshakeable chain of custody, the legal system relies on Bates Numbering.

What is Bates Numbering?

Invented in the late 19th century by Edwin G. Bates, a Bates stamp was originally a handheld mechanical device that advanced a four- or six-digit sequence with every downward press.

In modern legal practice, Bates numbering (or Bates stamping) is the process of applying an indexed, sequential alphanumeric identifier to every page of every legal document exchanged between parties.

A standard Bates number consists of three parts:

  • Prefix: Identifies the party or case (e.g., PLAINTIFF-, DEF-, EXHIBIT-A-).
  • Zero-Padded Numeric Sequence: Fixed-width digits (e.g., 000001 to 004520). Padded zeros ensure alphabetical file sorting matches numerical page order.
  • Optional Suffix: Denoting sub-files or confidential designations (e.g., -CONFIDENTIAL).

Why Standard Page Numbers Are Not Sufficient in Court

Standard page numbers (“Page 1 of 5”) reset with every single document. If you produce 30 separate 5-page contracts, you will have thirty different “Page 1s”.

During a high-stakes deposition or cross-examination in court, an attorney cannot say “Please look at Page 3 of the invoice.” The witness and judge will ask, “Which invoice?”

With Bates stamping, the attorney says: “Please turn to Bates Number PLAINTIFF-001248.” Every single page across millions of discovery records has a unique, unambiguous address.
